Terms of Service

These Terms of Service ("Terms") govern your access to and use of the fratOS platform, including all software, services, features, and content made available by fratOS ("we," "our," or "us"). By accessing or using fratOS, you agree to be bound by these Terms. If you do not agree, do not use the platform.

These Terms apply to all users of the platform, including organization administrators, approved members, alumni, and any other individuals who access or interact with fratOS.


1. Platform Description

fratOS is a private software platform designed exclusively for verified fraternity, sorority, and similar organizations. It provides the following core features:

  • Alumni Directory: A searchable, private directory of chapter alumni with profiles including professional information, contact details, and headshots.
  • Rush Management: Tools for tracking prospective members (rushees), managing recruitment stages, assigning tags and flags, logging notes, tracking event attendance, and coordinating recruitment workflows.
  • SMS Communications: An SMS messaging tool that allows authorized administrators to send recruitment-related and organization-related text messages to consenting individuals.
  • Email Communications: An email blast tool for sending announcements, updates, and campaign information to members and alumni.
  • Donation Campaigns: Tools for creating fundraising campaigns, accepting online donations via Stripe, and tracking donation progress.
  • Event Management: Tools for creating events, managing RSVPs, and tracking attendance.
  • Alumni Suggestion Portal: A form allowing alumni to recommend prospective members for recruitment consideration.
  • QR Check-In: QR code-based event check-in for rush events and other gatherings.
  • Billing and Subscriptions: Automated subscription billing for organizations using the platform.

Access to fratOS is granted only to individuals who are verified and approved by an existing organization administrator. The platform is not open to the general public.


2. Data Ownership and Rights

Your organization owns all of its data.

All data entered into fratOS by or on behalf of an organization — including but not limited to alumni records, member profiles, rushee information, notes, tags, ratings, event data, donation records, communication history, and any other content — is and remains the exclusive property of that organization.

fratOS does not claim any ownership, intellectual property rights, or license over your organization's data. Our platform simply maintains, organizes, and amplifies your data to make it more accessible and actionable for your organization.

2.1 What This Means in Practice

  • Full data portability: You may request a complete export of all your organization's data at any time, in a standard format (CSV, JSON). We will fulfill export requests within 14 business days.
  • No lock-in: Your data is never held hostage. If you choose to leave fratOS, we will provide your complete data and permanently delete it from our systems.
  • No monetization: We will never sell, license, aggregate, mine, or otherwise use your organization's data for any purpose other than providing the fratOS service to your organization.
  • No cross-organization sharing: Your data is stored in isolated, organization-specific database tables. No other organization can access your data, and your data is never combined with data from other organizations.
  • No AI training: Your organization's data is never used to train machine learning models, build aggregate datasets, or for any form of data analysis beyond what is necessary to provide the fratOS service.

2.2 Platform Intellectual Property

While your organization owns its data, the fratOS software, design, code, user interface, and proprietary features are the intellectual property of fratOS and its developers. You are granted a limited, non-exclusive, non-transferable, revocable license to use the platform for its intended purpose during the term of your subscription.

You may not copy, modify, reverse-engineer, decompile, distribute, or create derivative works from any part of the fratOS platform without our express written consent.


3. SMS Messaging Program

Program Name

fratOS Rush SMS Alerts

Program Description

fratOS Rush SMS Alerts is a recruitment and organization messaging program operated by individual fraternity and sorority chapters through the fratOS platform. Authorized chapter administrators may send informational SMS messages to prospective members (rushees), current members, and alumni who have voluntarily provided their mobile phone numbers through official intake forms. Messages may include event invitations, scheduling updates, recruitment status notifications, and general organization-related announcements. This program is strictly non-commercial and is used solely for chapter operations and recruitment purposes.

Message Frequency

Message frequency varies. Recipients may receive multiple messages per week during active recruitment periods, and fewer messages outside of those periods.

Message and data rates may apply depending on your mobile carrier and plan.

Opt-Out Instructions

To stop receiving SMS messages at any time, reply STOP to any message you receive. You will receive a one-time confirmation and no further messages will be sent to your number. To re-enroll, contact your chapter administrator directly.

By providing your mobile phone number to a fraternity or sorority chapter that uses fratOS, you consent to receive SMS messages from that chapter through the fratOS platform. Consent is not a condition of any purchase or service.

Phone numbers provided to fratOS are used solely to facilitate chapter communications as described above. Numbers are never shared with third parties for marketing purposes. See our Privacy Policy for full details.

SMS delivery is powered by Twilio. By using this platform, you acknowledge that message delivery is subject to carrier availability and is not guaranteed. fratOS is not liable for messages that are delayed, undelivered, or blocked by carrier filtering.


4. Eligibility and Accounts

  • You must be at least 13 years old to use fratOS.
  • You must be a verified member, alumnus, or authorized administrator of a participating fraternity, sorority, or similar organization.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
  • You must not share your account credentials with any other person.
  • You must provide accurate and complete information when creating your account and keep it up to date.
  • You must notify us immediately at zohairrk5@gmail.com if you suspect unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or pose a security risk.

5. Acceptable Use

You agree not to use fratOS to:

  • Send spam, unsolicited commercial messages, or any content unrelated to legitimate chapter operations, recruitment, or alumni engagement.
  • Harass, threaten, bully, or demean any individual.
  • Collect or store personal data of others beyond what is necessary for legitimate chapter operations.
  • Attempt to circumvent authentication, gain unauthorized access to other organizations' data, or reverse-engineer the platform.
  • Upload malicious code, viruses, or any content designed to disrupt the platform.
  • Violate any applicable federal, state, or local law, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and state privacy laws.
  • Send SMS or email messages to individuals who have opted out or who have not provided consent to receive such messages.
  • Impersonate any person, organization, or entity.
  • Use the platform for any purpose other than legitimate organizational operations.
  • Scrape, crawl, or use automated tools to extract data from the platform.
  • Resell, sublicense, or otherwise commercially exploit access to the platform.

Organization administrators are solely responsible for ensuring that SMS messages, emails, and other communications sent through fratOS comply with all applicable laws and regulations, including obtaining any required consents.


6. Billing and Payments

  • Subscription fees: Organizations are billed according to the subscription plan agreed upon during onboarding. Billing intervals may be monthly, quarterly, semiannual, annual, or one-time, as configured for each organization.
  • Setup fees: Some organizations may be subject to a one-time setup fee, which is charged when the organization first sets up billing on the platform.
  • Payment method: Organizations must provide a valid payment method (credit or debit card) through our secure payment processor, Stripe. By providing a payment method, you authorize us to charge the applicable fees automatically according to your billing schedule.
  • Failed payments: If a scheduled payment fails, we will attempt to collect payment again. If payment remains unsuccessful, we may suspend access to the platform until the outstanding balance is resolved.
  • Refunds: Subscription fees are generally non-refundable. If you believe you have been charged in error, contact us at zohairrk5@gmail.com and we will review on a case-by-case basis.
  • Price changes: We reserve the right to adjust pricing with at least 30 days' written notice to affected organizations. Price changes will take effect at the start of the next billing cycle.

7. Donations

  • Organizations may create donation campaigns through fratOS to accept contributions from donors.
  • Donations are processed through Stripe and are subject to a platform processing fee.
  • fratOS is not responsible for the use of donated funds by organizations. Each organization is solely responsible for how it uses and reports donations received.
  • Donors receive automated email receipts for their contributions.
  • Refund requests for donations should be directed to the receiving organization. fratOS will process refunds at the organization's request.

8. Data and Privacy

Your use of fratOS is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell or share your personal information with third parties for marketing purposes. All data is processed and protected in accordance with our Privacy Policy.

As stated in Section 2, all organization data entered into fratOS remains the property of that organization. fratOS acts solely as a data processor and platform provider. For complete details on how we collect, store, protect, and handle data, please refer to our Privacy Policy.


9. Disclaimers

fratOS is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not guarantee that the platform will be error-free, secure, or available at all times.

We are not responsible for the content of any messages sent by organization administrators through the SMS or email features. Each organization is solely responsible for the content, legality, and appropriateness of communications sent from their account.

We do not guarantee the accuracy, completeness, or reliability of any information entered into the platform by users or organizations. Organizations are responsible for verifying the accuracy of their own data.


10. Limitation of Liability

To the fullest extent permitted by applicable law, fratOS and its developers, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to damages arising from:

  • Undelivered or delayed SMS or email messages
  • Data loss or corruption
  • Unauthorized access to your account
  • Service interruptions or downtime
  • Errors or inaccuracies in the platform
  • Actions taken by organization administrators using the platform
  • Third-party service failures (Stripe, Twilio, Supabase, etc.)

Our total aggregate liability to you for any and all claims arising under these Terms shall not exceed the total amount paid by your organization to fratOS in the twelve (12) months immediately preceding the event giving rise to the claim, or $500, whichever is greater.


11. Indemnification

You agree to indemnify, defend, and hold harmless fratOS and its developers, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or related to: (a) your use of the platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) messages or content sent through the platform by you or your organization; or (e) any third-party claims related to your organization's use of the platform.


12. Termination

We reserve the right to suspend or terminate your access to fratOS at any time, with or without notice, for conduct that violates these Terms, is harmful to other users, the platform, or third parties, or for any other reason at our sole discretion.

Upon termination: (a) your right to use the platform ceases immediately; (b) we will provide a data export upon request within 30 days; (c) organization data will be deleted or anonymized within 90 days unless retention is required by law; (d) any outstanding payment obligations remain due and payable.

Provisions of these Terms that by their nature should survive termination (including but not limited to Sections 2, 9, 10, 11, and 13) shall survive termination.


13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, it shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of such courts.


14. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by providing notice via email or a prominent platform notification. Your continued use of fratOS after changes are posted constitutes acceptance of the updated Terms. We recommend reviewing these Terms periodically.


15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.


16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and fratOS regarding your use of the platform and supersede all prior agreements, understandings, and communications, whether written or oral, relating to the subject matter hereof.
